Payments:

Payments are due within 7 days of purchase. We accept all major credit cards, e-Checks, and certified checks. If paying with a credit card, Use the Gun Broker check out system to Help speed up the process.

Buyers who cancel or want to change their order will be subject to a 20% processing fee.

Know your State and Local Laws: Please verify with a local FFL dealer that the firearm you are looking at is legal to own in your area. We do not substitute or change magazines, make alterations to firearms or ship to areas where the item is prohibited. Do not purchase high capacity magazines if they are not allowed in your area.

Sales Tax is collected based on the ship to address.

All Items are Sold as is, we will do our best to describe and picture the condition of firearms. Factory new items have the manufacturers warranty.

 

TERMS AND CONDITIONS / TERMS OF SALE

Please read these Terms and Conditions of Sale (T&Cs or Agreement) carefully before purchasing from SC2AGuns, LLC, a South Carolina limited liability company doing business as AmmoJo.com (collectively we, us, or our), or before submitting any content to us. By placing an order with AmmoJo.com or SC2AGuns, LLC, or by submitting any content to us, you agree to be bound by this Agreement.

  1. Important information to note

Some of our products, including but not limited to firearms, ammunition, magazines, and other weaponry or restricted items, are subject to specific restrictions on sale, delivery, and transport as required by local, state, and federal laws and regulations (Laws). All such Laws are incorporated by reference into these T&Cs.

By purchasing from us, you affirm that:

  • You are at least 18 years of age for general merchandise and at least 21 years of age for items where required by applicable Law, or
  • You are an emancipated minor or have valid parental or guardian consent, and
  • You are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these T&Cs and to abide by and comply with this Agreement.

All information provided on our product listings is believed to be accurate at the time of publication. However:

  • We may display an image of only one size or variation of a product, as images for every variation may not be available.
  • Product descriptions, images, packaging, formulas, and ingredients may be changed at any time by the manufacturer.
  • You should always refer to the manufacturer website for the latest and most accurate product information.

We ensure that items are in stock at the time they are made available for sale. Inventory levels can change quickly, and we cannot guarantee immediate availability in every case. If an item is on backorder after you place your order, we will honor the listed price and ship your item as soon as it becomes available, or, at your request, cancel your order and issue a refund.

Because of a high volume of non-paying orders, inventory is not reserved until payment has been successfully processed. Please submit payment as soon as possible after placing your order.

  1. Content and description of products

All information provided in our listings is believed to be accurate at the time of publication to the best of our ability but may contain typographical or other errors.

  • Images are for reference only and may depict one variation or size of a product rather than the exact configuration you are purchasing.
  • Product descriptions and images may differ slightly from updated manufacturer packaging or minor product revisions.
  • You are responsible for reviewing the full title and description of an item to ensure it is the product you want.

We may provide general information regarding Laws and restrictions that apply to some of our products, including but not limited to firearms, ammunition, magazines, and other regulated products. However, we do not represent or warrant that any such information is complete, current, or accurate for your specific jurisdiction.

You agree that:

  • It is your explicit responsibility to know, understand, and comply with all Laws that apply to you, your location, and your purchase.
  • Nothing in these T&Cs or on our site relieves you of your responsibility to comply with applicable Laws.
  • You will not request or direct shipment of any product to any jurisdiction where possession, sale, shipment, or use of that product is prohibited or restricted.

We reserve the right at any time to:

  • Add, change, modify, suspend, or discontinue any product;
  • Limit quantities;
  • Limit or discontinue services or features associated with our site, at our sole discretion and without notice or liability.
  1. Misprints

Product descriptions and specifications are primarily provided by manufacturers and other third-party sources. Although we make reasonable efforts to ensure accuracy, we are not responsible for typographical errors, pricing errors, or omissions.

If you have any questions about a product, you must contact us before ordering. We will not be liable for errors or omissions in product descriptions, pricing, or specifications.

  1. Pictures

Pictures are provided as a convenience to our customers and are intended as a general representation of the item or a group of similar items.

  • The image shown may not be an exact match to the specific model, configuration, or packaging you receive.
  • Some manufacturers do not provide images for all SKUs they produce. In these cases, we may substitute a picture of a similar or related item.

Always rely on the written title, description, and specifications, not solely on the image, when making a purchase decision.

  1. Shipping and delivery
  • We ship only to the fifty United States.
  • We do not ship to APO or FPO addresses, Guam, Puerto Rico, or to freight forwarders.
  • Requests to ship outside the fifty United States will not be honored.

Free shipping offers, when advertised, are valid only for the contiguous lower forty-eight states. Orders shipping to Alaska or Hawaii are excluded from free shipping offers and will be charged applicable air or other shipping rates.

Most orders ship within 2 to 10 business days after payment has been processed. Firearms and other regulated items may take longer due to FFL processing or compliance checks. We do not process or ship orders on Sundays.

Ship and delivery dates are estimates only and are not guaranteed under any circumstances, regardless of shipping method. Any dates provided, whether verbal or written, are based on average carrier performance and are subject to delay.

Orders canceled or returned due to shipping or delivery delays are subject to all applicable cancellation and return fees described in this Agreement.

  1. Lost, stolen, or damaged packages

If a package is lost, stolen, or damaged in transit:

  • A claim must be filed with the shipping carrier.
  • Any damage must be reported to us within 2 days of receipt of the package.
  • No replacements or refunds will be issued until the carrier has completed its investigation and approved the claim.

Once the carrier approves and pays the claim, we may, at our discretion, either:

  • Send a replacement, or
  • Issue a refund.
  1. Customer responsibility for shipping charges, costs, and fees

You are fully responsible for all shipping-related charges, costs, and fees, including but not limited to:

  • Undeliverable addresses;
  • Refused packages;
  • Address changes after shipment;
  • Third attempt undeliverable packages;
  • Cancellation of an order after it has shipped;
  • Return of packages to our facility with or without prior notification or a return merchandise authorization number (RMA).

These charges, costs, and fees may include:

  • Initial shipping charges to the customer;
  • Shipping charges, costs, and fees to return the package to our facility;
  • Shipping charges, costs, and fees to reship the package to the customer;
  • Any additional carrier or handling fees.

If a package is returned to an incorrect facility or warehouse, you are responsible for any charges, costs, and fees necessary to route the package to the proper facility.

If you refuse to pay any shipping-related charges, costs, or fees incurred after the initial shipment, we reserve the right to deduct all such amounts from any refund due.

Once a package has been returned to our facility, we will attempt to contact you using the contact information you provided. You have 2 business days from the time the package is delivered back to our facility to contact us and arrange reshipment.

If you do not contact us within 2 business days, we may:

  • Ship the package to the appropriate facility or warehouse if necessary; and
  • Issue a refund to you, minus all applicable charges, costs, and fees as described in this Agreement.
  1. FTC and UCC shipping terms

Federal Trade Commission rules:
All orders are shipped F O B origin. You assume liability for the goods when we hand them over to the carrier for shipment.

Uniform Commercial Code:
Our shipments are deemed shipping contracts under applicable UCC provisions. Title to the goods passes to you when the goods are delivered to the carrier.

  1. Address corrections and package intercepts
  • Address corrections or changes after an order has shipped: minimum of 20 dollars plus any carrier shipping fees.
  • Package intercepts: minimum of 20 dollars plus any carrier shipping fees.
  1. Payments by credit card

We accept major credit cards as a form of payment. To reduce credit card fraud, we reserve the right to request verification of cardholder identity, which may include:

  • A copy of the credit card; and
  • A copy of a valid government-issued photo ID.

We may require these documents especially when the shipping address differs from the verified billing address.

We reserve the right, in our sole discretion, to decline any credit card transaction that does not meet our internal security policies.

You agree not to dispute or initiate chargebacks for any charge that you authorized. If an item is:

  • Returned in accordance with this Agreement, or
  • Lost in shipping and the carrier claim is approved,

we will issue a credit back to your credit card instead of a chargeback.

If you violate this provision and initiate a chargeback contrary to this Agreement, you will be liable for:

  • The full amount of the chargeback;
  • Any bank fees or chargeback fees; and
  • Any additional liquidated damages as set forth in this Agreement.
  1. Chargebacks and canceled checks

You agree not to take any actions that dispute or attempt to recover charges, costs, or fees that we have collected or deducted from your account or refund where such charges are permitted by this Agreement. This includes, but is not limited to:

  • Credit card chargebacks;
  • Canceling checks or payment reversals.

If you pursue such actions, you agree to pay all charges, costs, and fees we incur in defending against those actions, including reasonable attorneys fees and court costs.

  1. Order cancellation and fees

You may request cancellation of your order at any time before it ships. However:

  • An order is not considered canceled until we verify that it has not shipped and we send you written confirmation of cancellation.
  • Due to the speed and automation of our fulfillment process, it may not be possible to cancel an order before it ships.

Many products ship from different warehouses or directly from manufacturers. Orders are often transmitted to the shipping location within minutes, packed, labeled, and staged for carrier pickup.

Because of this process:

  • It may take one business day for us to respond to cancellation emails, and by that time the order may already have shipped.
  • Your order status may still show as processing in our system even after it has left the warehouse.

If your cancellation request is received and processed before shipment:

  • A cancellation fee of 10 percent of the order total, or 10 dollars, whichever is greater, will apply.

If you refuse delivery of any package that has shipped:

  • You will be charged shipping both ways, plus any applicable restocking and administrative fees.

Once an order has shipped, it cannot be canceled. You must follow the return procedures in this Agreement.

We reserve the right to cancel any order at any time and for any reason, including but not limited to suspected fraud, pricing errors, regulatory concerns, or product unavailability.

  1. Exchange and refund policy

For a prompt exchange or refund, please retain your invoice.

If you need to return merchandise for an exchange or refund, all of the following conditions must be met:

  • The item is returned in its original packaging.
  • The item is returned within 15 days of the delivery date.
  • The item and packaging are in new, unopened, and resellable condition.
  • A copy of the invoice is enclosed with the merchandise.
  • You have contacted us, obtained an RMA number, and clearly written the RMA number on the outside of the package.
  • You ship the goods to the exact warehouse or address specified in the RMA.

You are responsible for confirming the correct return address before shipping any goods back. Any goods returned to an incorrect address may incur additional shipping and handling charges. We are not responsible for goods returned to the wrong location.

You must enclose a brief written explanation of the reason for the return and whether you are requesting an exchange or a refund.

Merchandise returned for refund is subject to:

  • A 15 percent restocking fee, with a minimum restocking fee of 5 dollars.
  • No refund of outbound shipping charges.
  • If the original order qualified for free shipping, our normal shipping cost will be deducted from your refund.

All returns must be prepaid. We do not accept C O D returns.

  1. Item condition and packaging

Items will only be accepted for return if both the item and all original packaging are in new, unopened, and unused condition. This includes, but is not limited to:

  • Blister packs;
  • Shrink wrapping;
  • Manufacturer seals.

Certain manufacturers do not allow returns if the blister pack or shrink wrapping has been opened, even if the item appears unused.

  1. Returns and exchanges not allowed

Returns and exchanges are not allowed on the following items. All sales are final on these products:

  • Air pistols, air rifles, and any other type of air gun
  • Ammunition
  • Optics, including scopes, red dot sights, spotting scopes, binoculars, and night vision
  • All Leupold brand items
  • All CAS Hanwei brand items
  • Black powder and smokeless powder
  • Primers
  • Safes
  • Undergarments and swimwear
  • Safety gear including harnesses, helmets, and ropes
  • Tree stands
  • Bows and crossbows
  • First aid items
  • Food items
  • Firearms once transferred to you by your FFL

If the merchandise you wish to receive in exchange is out of stock, we will issue a refund or credit as appropriate.

All refunds for orders paid by credit card will be issued as credits to the same card used for the original purchase when possible.

In cases where we are unable to accept a return due to manufacturer restrictions, you must contact the manufacturer directly for warranty or service.

Any questions regarding exchanges or refunds should be directed to our customer service department.

 

Firearm returns: 

Please inspect all firearms thoroughly before proceeding with the transfer. Once a firearm is transferred to you it is considered used, even if unfired. We cannot provide a full refund for new firearms once they have been transferred into your possession. We do not reimburse FFL transfer fees on returned items. We do understand that some manufacturer defects may not be identifiable upon initial inspection. Any defect discovered after the transfer of the firearm must be returned directly to the manufacturer for repair or replacement in accordance with the warranty policy. By sending a defective firearm directly to the manufacturer, you can avoid unnecessary transfer fees.

  1. Firearms

If a product is classified as a firearm, it must ship to a Federal Firearms Licensee (FFL) in your state. You are responsible for:

  • Selecting an FFL from our checkout list or providing us with your preferred FFL information;
  • Ensuring your chosen FFL will accept the transfer;
  • Any transfer fees charged by your FFL.

You are solely responsible for verifying that the firearm you order is legal in your state and local jurisdiction.

If you order a firearm that you cannot possess under applicable Law:

  • You are responsible for returning the firearm to us; and
  • The return will be subject to our restocking fees and shipping cost deductions as provided in this Agreement.

For all firearm purchases, we must receive a copy of your dealer FFL no later than 5 calendar days from the date of your order, or your order may be canceled. Please ensure your FFL includes your order number when sending their license.

All firearms must be inspected at the time you pick them up from your FFL:

  • Any defects or damage must be reported to us immediately while you are still at the FFL location.
  • Do not complete the transfer if the firearm is in unacceptable condition.

Once a firearm has been transferred to you by the FFL, it is considered used and is no longer returnable. Any further issues must be addressed through the manufacturer warranty.

  1. Warranty, defective items, and missing parts

All warranties are provided by the product manufacturer, not by AmmoJo.com or SC2AGuns, LLC. We are not a repair facility and do not accept items for repair or warranty work.

If a product is missing parts or appears defective:

  • You should first contact the manufacturer directly for replacement parts, warranty service, or repair;
  • Claims for missing items or items damaged in transit must be reported to us within 3 business days of delivery.
  1. Indemnification

You agree to indemnify, defend, and hold harmless SC2AGuns, LLC, AmmoJo.com, our parent, subsidiaries, affiliates, officers, agents, co-branders or other partners, and employees (each a Covered Party) from and against any and all claims, actions, proceedings, suits, liabilities, damages, settlements, penalties, fines, costs, and expenses, including reasonable attorneys fees and dispute resolution expenses, arising out of or related to:

  • Your actions or omissions in violation of applicable Laws;
  • Any content, information, or submission you provide, including any false or misleading information;
  • Any purchase order or delivery instructions you provide that violate applicable Laws;
  • Any actions or omissions taken by SC2AGuns, LLC or AmmoJo.com in reliance on your purchase orders or delivery instructions that violate applicable Laws;
  • Any actions or omissions taken by SC2AGuns, LLC or AmmoJo.com in violation of applicable Laws to the extent caused by erroneous or false information provided by you;
  • Your use or misuse of our website, listings, or advertising;
  • Your use or misuse of any products purchased from us;
  • Your breach of any term of this Agreement.
  1. Feedback and reviews

We welcome honest, truthful feedback and reviews. However, you agree that you will not knowingly make untrue, defamatory, or malicious statements, whether written or spoken, about SC2AGuns, LLC, AmmoJo.com, or our owners, employees, or affiliates in any public or private forum.

Knowingly publishing or communicating false, unsubstantiated damaging statements may constitute defamation, libel, or slander and will be treated as a breach of this Agreement, subject to the liquidated damages provision set forth below, in addition to any rights we may have under applicable Law.

  1. Dispute resolution

If a dispute arises between you and us, our goal is to provide a neutral and cost-effective means of resolving the dispute quickly. We strongly encourage you to first contact us directly to seek resolution by email at support@ammojo.com (or another customer service contact listed on our site).

We will consider reasonable requests to resolve disputes through alternative dispute resolution procedures such as mediation or arbitration as alternatives to litigation.

  1. Choice of law and forum; liquidated damages

This Agreement shall be treated as though executed and performed in Lexington County, South Carolina and shall be governed by the laws of the State of South Carolina without regard to conflict of law principles.

You agree that any claim or dispute you may have against us must be resolved by a court of competent jurisdiction located in Lexington County, South Carolina, unless the parties otherwise agree in writing. You consent to the personal jurisdiction of the courts located in Lexington County, South Carolina for the purpose of litigating any such claim or dispute.

SC2AGuns, LLC sets the sum of 1,500 dollars as liquidated damages for each material breach of this Agreement, in addition to a reasonable attorneys fee, court costs, and service of process fees.

  1. Improperly filed claims

All claims you bring against us must be resolved in accordance with the dispute resolution and forum provisions of this Agreement. Any claim filed or brought contrary to those provisions shall be considered improperly filed.

If you file an improperly filed claim:

  • We may seek to recover attorneys fees and costs incurred in responding to the claim,
  • Provided that we have notified you in writing of the improper filing and you failed to promptly withdraw or correct the claim.
  1. Applicable taxes and fees

Most states now require online retailers to collect and remit sales tax based on economic nexus standards. We collect applicable state and local sales taxes and, where required, compliance or other fees based on the shipping address of your order.

You are responsible for any additional taxes, duties, or fees imposed by your jurisdiction that we are not required to collect at checkout.

  1. Miscellaneous

If any part of this Agreement is held invalid or unenforceable, that portion will be construed in a manner consistent with applicable Law, and the remaining provisions will remain in full force and effect.

To the extent that anything on our website or in any related materials conflicts or is inconsistent with this Agreement, this Agreement controls.

Our failure to enforce any provision of this Agreement does not constitute a waiver of that provision or our right to enforce it in the future.

You expressly authorize us to comply with any and all lawful notices, subpoenas, court orders, or warrants without prior notice to you.
